ORDER OF THE BOARD ~y B. Forcade):

The City of East Peoria is hereby granted a variance from 35

Ill. Adm. Code 306.303 and 306.304 subject to the following

conditions:

1.  This variance shall expire July 1, 1988.

2.  This variance shall apply only to the 19 overflow points

identified in the Petition for Variance.

3.  By June 30, 1985, East Peoria shall submit to the Agency

a compliance plan which shall include, but not be

limited to:

A)  a cost—effectiveness analysis to determine the most

reasonable means to come into compliance.

B) a detailed investigation of the financial

requirements to come into compliance.

C) an evaluation of whether the project can be

segmented such that portions of the project can

commence construction as soon as possible.

4.  By March 31, 1986, East Peoria shall complete and submit

final plans and specifications to implement the

compliance plan.

5.  East Peoria shall attain final operational status by

July 1, 1988.

6.  East Peoria shall continue to submit monthly overflow

reports. These reports shall include all bypasses,

shall separate bypasses into individual events rather

than monthly totals, and shall indicate how durations

were determined.

7.  East Peoria shall not install any additional bypasses

without obtaining appropriate variance relief prior to

their installation.

8.  East Peoria shall clean the East Oakwood sewer as

necessary to minimize bypassing, but in no event less

than twice yearly; and

9.  Within thirty—five (35) days of the date of this Order,

East Peoria shall execute and send to Gary Reside, DWPC,

Compliance Assurance Section, Illinois Environmental

Protection Agencyç 2200 Churchill Road, Springfield,

Illinois. 62706ç Certification of Acceptance by which

it agrees to be hound by the terms and conditions of

this variance. ~iis 35 day period shall be held in

abeyance for any period during which this matter is

being appealed. The form of said certification shall be

as follows
