THE BOARD (by J. D. Dumelle):
This matter comes before the Board upon a February 19, 1984
petition for variance filed on behalf of the Metropolitan
Sanitary District of Greater Chicago (MSD). While the MSD waives
hearing, the Board on its own motion orders that a hearing be
held.
The Board notes that the petition fails to indicate any
plan for ultimate compliance with the rules from which variance
is requested and fails to include the raw
data regarding fecal
coliform water quality upon which the table on page 3 of Ex. 5
of the petition is based. The Board expects that this information
will be forthcoming at hearing.
