ORDER OF THE BOARD (by B. Forcade):
On July 31, 1986, Respondent Dunn Company filed a Motion to
Withdraw Answer, Motion to Dismiss Complaint and Motion to Make
Complaint More Definite. Complainant filed no response.
Dunn Company moves to withdraw its answer previously filed
in this matter. That motion is granted. Dunn Company moves to
dismiss the complaint as it fails to list the dates, location,
affect, nature, extent, duration and strength of drainage or
emissions and consequences alleged to constitute violation of the
Illinois Environmental Protection Act and regulations; and that
the complaint fails to contain a concise statement of relief
sought. That motion is denied. Dunn Company requests that,in
the alternative to its Motion to Dismiss, the complaint be made
more definite. That motion is denied.
This proceeding is approximately three years old and has yet
to proceed to hearing despite numerous prehearing conferences.
Hearing in this matter must be scheduled within 30 days and held
within 60 days or this matter will be subject to dismissal.
IT IS SO ORDERED.
