    OPINION AND ORDER OF THE BOARD (by

    This provisional variance request
    comes before the Board upon
    a July 26, 1983 Recommendation of the Illinois Environmental
    Protection Agency
    (Agency).
    The Agency recommends that a 5—day
    provisional
    variance be granted
    to the City of Wood River (Wood
    River) to
    allow bypassing of its
    wastewater treatment plant (WWTP)
    so that the
    sluice gates in
    the
    gatewell structure of a 24—inch
    effluent pipe
    can be
    replaced.
    Wood River
    owns and operates
    a WWTP which serves about 12,500
    people. The
    Petitioner’s WWTP
    includes influent pumps, bar screen,
    grit chamber,
    and two primary
    clarifiers. The
    WWTP,
    which
    discharges
    directly to the tliss:Lssippi River
    pursuant to NPDES
    Permit
    No. IL OO31852~~has a design average flow
    of 1.7 million
    gallons per day.
    Wood
    River is participating in the
    Construction Grants
    Program and is
    currently in the
    process of upgrading its WWTP
    to a regional
    treatment facility
    to serve the nearby villages of
    South Roxana
    and Hartford, Amoco Chemical
    Corporation (Amoco)
    and the City
    of Wood River itself. The
    upgrading of the Petitioner’s
    WWTP
    has
    been
    divided into two
    phases.
    Construction in Phase I began
    in April,
    1983 and is scheduled to be
    completed
    in
    April, 1983.
    This one—year
    construction
    project includes:
    (1) construction
    of a grit chamber/bar screen as preliminary treatment facilities;
    (2) upgrading
    and expansion of the
    present primary clarifiers;
    (3) construction
    of flow measurement; (4)
    renovation of the sewage
    pump station and
    the existing Wood River
    plant service building;
    (5) construction
    of a pumping station
    and forcemain (to direct
    primary treated
    flow to the Amoco WWTP);
    and
    (6)
    construction
    of a primary
    sludge force main from
    the primary facilities to the
    Amoco aerobic
    digester. When Phase I
    of the construction project
    is completed,
    the Petitioner’s WWTP will
    have primary treatment
    capacity
    for 2,46 million gallons per
    day DAF and 6.2 million gallons
    per day DMF.

    Construction in Phase II is scheduled to begin in October,
    1983 and is expected to be completed in October, 1984. The Phase
    II project includes: (1) renovation of Amoco’s WWTP (which was
    given to the City of Wood River by Amoco) to utilize Amoco’s
    “ciariflotator” for the pretreatment of Amoco’s flows; (2) reno-
    vation of Amoco’s final clarifier, aeration tank, aerobic digester,
    and lagoons for storage of excess wastewater during single—unit
    outage; (3) conversion of Amoco’s final filter to a chlorine
    contact tank; (4) upgrading and expansion of Amoco’s sludge
    dewatering facilities; and (5) construction of chlorination
    facilities. (Rec. 2). When construction is completed in October,
    1984, the WWTP will be rated at 5.1 million gallons per day DAF
    and 9.8 million gallons per day DMF,
    The Petitioner has stated that, in order to proceed with its
    Phase I construction plans, it needs to replace the sluice gates
    in the gatewell structure of the 24—inch effluent pipe. In order
    to make these necessary repairs, Wood River has requested per-
    mission to bypass the grit chamber and primary clarifiers for
    approximately 5 days, (Rec. 3). During this 5-day bypassing
    period, the Petitioner plans to discharge untreated wastewater
    directly into the Mississippi River. This untreated wastewater
    will probably contain levels of BOD which average between 175
    mg/i and 280 mg/i and levels of TSS which average between 74 mg/i
    and 89 mg/l during an 8½ hour workday with the peak being sometime
    in the mid—morning. (Rec. 3). A temporary screening will be
    provided before bypassing in the 84—inch combined interceptor
    sewer.
    The Agency has noted that, although bypassing will probably
    occur at a time when the Mississippi River is at a relatively low
    level, there is no reasonable alternative to bypassing and denial
    of the provisional variance would merely serve to add additional
    expenses and unnecessary delay to the construction of a needed
    wastewater treatment facility. (Rec, 4).
    The Agency has concluded that compliance on a short—term
    basis with the provisions of 35 Ill. Mm, Code 306.305 would
    impose an arbitrary or unreasonable hardship. It, therefore,
    recommends that the Board grant the City of Wood River a provi-
    sional variance from Section 306.305 for the period of July 27,
    1983 through August 3, 1983, subject to certain conditions.
    Pursuant to Section 35(b) of the Illinois Environmental
    Pro—tection Act, the Board hereby grants the provisional variance
    as recommended.

    ORDER
    The City of Wood River is hereby granted a provisional variance
    from 35 Iii. Mm. Code 306.305 for the period of July 27, 1983
    through August 3, 1983, subject to the following conditions:
    1. Wood River shall notify Robert E. Broms, P.E.,
    Manager, Compliance Assurance Section, Division of Water Pollution
    Control at 217/782—9720:
    a.) the day construction on the sluice gates begins;
    b.) the day construction on the sluice gates is completed
    and all bypassing ceased;
    2. Wood River shall provide screening for all flows prior
    to bypassing~
    3, Wood River shall report, within 7 days after completion
    of construction on the sluice gate, the dates and times bypassing
    occurred and submit these reports to:

    4. Within 10 days of the date of the Board’s Order,
    Wood River shall execute a Certificate of Acceptance and Agreement
    which shall be sent to: Illinois Environmental Protection Agency,
    Division of Water Pollution Control, Compliance Assurance Section,
    2200 Churchill Road, Springfield, Illinois 62706. This certi-
    fication shall have the following form:

    PCB 83—98 dated July 26, 1983, understand and accept said Order,
    realizing that such acceptance renders all terms and conditions
    thereto binding and enforceable.
