On June 13, the Agency moved for leave to file its
Recommendation, due July 1, on August 5, as certain information
regarding the status of the Milan interceptor sewer project will
not be available until that
time.
The motion recited that Oak
Grove had no objection to the extension,
In order to grant this request, the Board must construe Oak
Grov&s lack of objection as a ~g, tanto waiver of the decision
period, that is, an extension of the decision period for 35 days.
The Agency’s motion
is granted.
