INTERIM
ORDER
OF THE BOARD (by J. Anderson):
On March 24, 1980, the Village of Lemont petitioned for vari-
ance from the 15 pCi/l gross alpha particle activity maximum limit
contained in Rule 304(c) of Chapter 6: Public Water Supply. The
90—day decision period was waived. The original Recommendation of
the Agency, filed May 9, 1980, supporting grant of variance, lists
test results from various dates in 1979. Hearing was held
May
16,
1980, at which citizen objectors were heard.
In light of the Agency’s admission in City of Minonk, PCB 80—
136, October 2, 1980, pp.1—2, that the Agency’s radiological test-
ing methodology had an “accuracy problem”, the Board must assume,
unless informed otherwise, that the test results included with the
petition cannot be relied upon. Unreliable results cannot support
the grant of the variance requested, as it is possible that accurate
tests will show that no variance is needed.
If an amended petition containing gross alpha particle activity
test results dated on or after August 22, 1980 is not submitted to
the Board within 45 days of the date of this Order, this petition
will be subject to dismissal.
