ORDER OF THE BOARD (By B. Forcade):
On April 23, 1985, Celotex filed a motion to the Board to
overrule the Hearing Officer, or in the alternative, to allow an
interlocutory appeal. That motion seeks “to overrule the Hearing
Officer’s denial of Celotex motions directed to discovery of
information concerning procedures to be used by Complainant in
collecting, preserving and analyzing samples to be taken from the
Celotex site (Motion, pp. 1—2, emphasis added).
That motion is denied. The Board notes that Celotex will
receive split samples from Cemplainant and that the Hearing
Officer Order in no way restricts Celotex from acquiring
information at a later date about analytical procedures already
completed.
