    ORDER
    OF THE BOARD ~by 3. D. Dumelle):
    On April 21, 1983 the Board modified the original Order
    in this matter which had been issued on February 15, 1979.
    The modification was at Petitioner’s request and provided
    terms more stringent than those originally ordered. Hearing
    on the modifications was therefore deemed perfunctory. With
    its April 21st Order the Board retained jurisdiction of the
    matter so that any significant changes in fact or law occurring
    after that Order could expeditiously be considered.
    On May 13, 1983 the United States Environmental Protection
    Agency issued a letter notifying the Agency and Petitioner
    that this matter would be disapproved as a State Implementation
    Plan amendment if hearing is not held. Therefore, Petitioner
    again moved for hearing on May 18, 1983. To avoid disapproval
    for lack of hearing, while it appears that this matter is otherwise
    satisfactory, Petitioner’s motion is granted.
    IT IS SO ORDERED.
