ORDER OF THE BOARD (by Mr. Young):
A Petition for Review of NPDES Permit issued by the Agency,
containing several conditions to which Goodrich Chemical objects,
was filed pursuant to Rule 502(b) on July 27, 1978. On August
22, 1978, the Environmental Protection Agency filed a ~4otion
for Specification of Errors in accordance with Rule 502 (h) (7)
of the Board’s Procedural Rules. Petitioner was granted an
extension until September 29, 1978, to respond to the Agency
Motion and the response was timely filed.
Rule 502 (b) (7) reads, in part: “The Board upon motion
of any respondent shall
,
require of the petitioner a
specification of the errors upon which the petitioner relies
in his petition.”
The Respondent’s Motion will be granted; Petitioner shall
amend the Petition to specify the errors upon which the Peti-
tioner relies. It is not the intention of the Board to require
that Petitioner plead his evidence hut rather that a short,
concise statement be provided detailing the reasons that Peti-
tioner believes that the conditions imposed by the permit are
not supported in fact or law and are in derogation of the
authority of Rule 910 of Chapter 3 of the Board’s Rules and
Regulations.
