THERMAL STANDARDS FOR THE

JOPPA GENERATING STATION

ORDER OF THE BOARD (by Mr. Young):

This matter is before the Board on the Petitioner’s

Motion (Pet. 3, par. 7) that the Board’s determination

be

made on the basis of the pleadings and supporting documenta—

tion already filed herein.

On June

24,

1977, the Agency

filed a waiver of its right to a hearing and suggested that

the Board render a decision based on the pleadings.

The

Petitioner’s

Motion is hereby denied and the hearing shall

be held.

The Board notes, however, that no objections have

been filed to this petition and if no citizen opposition to

this petition arises at the hearing, Petitioner may renew

this Motion and rest its case on the pleadinqs and supporting

documentation.
