CONCURRING OPINION (by Mr. Dumelle):
My preference would have been for a monetary penalty in
this case. Lake Zurich, as a community of 6,789 people, is not
too small to operate its costly sewage treatment plant according
to State regulations. And expensive sewage treatment plants are
not merely wide places in a sewer outfall~sjourney to the river.
The Order does finally put Lake Zurich on a tight program
of correction. As a deterrence to others and as an aid in the
enforcement of the Environmental Protection Act I would have
levied a penalty of at least $500.
