BOARD (by Mr. Zeitlin):

There being contested issues of fact in this matter, a hearing

is hereby authorized. Sufficient time for review of the transcript

of such hearing does not remain within the 90—day decision period

allowed by statute, and the additional 11 days allowed by Petitioner

in a waiver filed December 2, 1976. In the absence of a further

waiver, the Petition in this matter may be subject to dismissal for

insufficiency
