filed
a
Petition
for Variance before the Board on September 1, 1976. On September
27, 1976, the Environmental Protection Agency (Agency) filed a Motion
to Dismiss or in the Alternative, to make more Definite and Certain.
On October 18, 1976, the parties jointly submitted a Stipulation in
which Harvester agreed to submit an Amended Petition in keeping with
the objections raised in the Agency~s Motion within 60 days of the
date of the Stipulation. Harvester further agrees that the statutory
90-day requirement shall begin to run from the date of said Amended
Petition.
The Board, accepts the Stipulation submitted by the parties and
will entertain the Agency~s Motion after the 60-day period has run.
