ENVIRONMENTAL
PROTECTION AGENCY,
Respondent.
ORDER OF THE BOARD (by Mr. Dumelle):
Petition filed October 21, 1976 is inadequate in that the
amounts
by
which the limits of Rule 408
of
the Water Pollution Control
Rules will he exceeded are not clearly given nor is the effect
delineated upon water quality in the streams affected.
Furthermore, the “short—term increases in turbidity and
both
suspended and dissolved solids in the immediate vicinity
of the
dredging operation” are not quantified as to duration or
strength. The cost of the treatment plant alternative is not
qiven nor is the cost of a failure to dredge.
Petitioner shall amend the Petition within 45 days from the
date of this Order to provide the necessary information discussed
above. A waiver of the 90—day decision period set
by State statute
shall also be
filed
with the Board and Aqencv to
run
from the date
off
lung the Amended Petition.
