ORDER OF THE BOARD (by Mr. Zeitlin):
The Board’s Principal Opinion and Order in this matter was
entered on December 16, 1976. On January 24, 1977, Petitioner Hyon
filed a Motion for Clarification with regard to one of the Board’s
findings in the case; specifically, that the Board determine precisely
the period for which it is entitled to a permit.
Our finding in this matter that the period for which Hyon was
issued a permit was unreasonable as a condition on the permit does
not imply that any other period of issuance has been determined to
be proper. The permit was remanded to the Agency for consideration
in light of our Opinion and Order, which consideration should include
determination of the appropriate period of duration for the permit.
Our Opinion and Order clearly so stated, (p. 9).
Hyon’s Motion for Clarification is denied.
