ORDER OF THE BOARD (by.Mr. Dumelle):

On June 20, 1977 Petitioner filed a motion to consolidate

this appeal of a permit denial with a regulatory proceeding

which Petitioner has filed. Because these two proceedings

are governed by different procedural rules and different

standards of proof, the motion is denied.

In the alternative, Petitioner asked that hearings in

this matter be postponed until the companion regulatory

proceeding has been decided. Because the Board has already

ordered that hearings be held in this matter and because

this matter was filed before the Board in September, 1975, this

motion is also denied.
