ORDER OF THE BOARD (by Mr. Goodman):
This matter comes before the Board upon Respondent’s
Motion for Interlocutory Appeal in this cause. Because of
the history and litigation surrounding the subject matter of
this action and the relative position of Complainant and
Respondent, the Board feels that justice would be better
served and the matter expedited if the interrogatories
required by Respo~identwere to be answered in the form of a
deposition at a are—conference hearing as proposed by the
Hearing Officer. Respondent’s Motion for Interlocutory
Appeal is hereby aenied.
The Board hereby modifies the August 21, 1975 Order of
the Hearing Officer as follows:
Paragraph 1, second sentence, delete “September 15”
and add “October 1”; fifth sentence delete the word “expert.t’
Paragraph 2, delete the entire paragraph and add in its
place as fo11ows~ “The Complainant Joseph T. Enders is
ordered to be prt~paredto
give
oral answers to such oral
interrogatories prepounded by the Respondent on October 6,
1975, at 2 p.m. in the Fire Station Meeting Room, 1600
Bloomingdale Avenue, Glendale Heights, Illinois, at a pre—
trail deposition in the presence of the Hearing Officer.
