ORDER OF THE BOARD (by Mr. Dumelle):

Petition filed June 20, 1975 is inadequate in that actual

ambient air quality data are not given and only conclusory statements

are presented (see p~20 and pp, 23-~24of Petition),

Petitioner shall amend the Petition within 30 days of

the date of this Order and shall supply the most recent actual

particulate ambient air quality data sufficient to satisfy the

criteria set forth in Train v, NRDC (April 16, 1975)

The 90~ciaydecision period set by statute shall commence

upon the filing of the Amended Petition, A waiver of the 90~day

period to so commence shall be executed by the Petitioner at the

time of submission of the Amended Petition,

Failure to timely file the Amended Petition shall render

the Petition liable to dismissal

for

inadequacy,
