INTERIM ORDER OF THE BOARD (by Dr. Odell)
Petitioner is ordered to supply such additional in~
formation as may be required by the United States Supreme
Court decision, Train v. Natural Resources Defense Council,
43 LW 4467 (April 15, 1975) for the consideration of a
variance beyond July 31, 1975. There should be testimony or
data in the record from which the Board could determine
whether the grant of a variance would interfere with the
attainment
or
maintenance of national ambient air quality
standards in the area affected by the Petitioner~s facility.
Petitioner shall amend the petition within thirty (30)
days to provide the needed information concerning air quality.
Failure to timely file the information shall make the petition
subject to dismissal for inadequacy. The 9O~day decision
period set by statute shall run from the date of filing the
additional information.
