INTERIM ORDER OF THE BOARD (by Mr. Zeitlin):
The Board on April 24, 1975, granted Petitioner Metropolitan
Sanitary District of Greater Chicago’s Motion for Stay in
this matter, pending resolution of a currently pending
enforcement case brought by the Environmental Protection
Agency against Petitioner. Thereafter on May 6, 1975, the
Agency filed a Motion to Reconsider that decision, which
Motion is the subject of this Order.
The Agency requests that the Board reconsider and
reverse the April 24, 1975, Order allowing Petitioner a
stay in this case. The grounds alleged by the Agency in
support of its Motion are insufficient; they include a
notation that Petitioner’s Request for a Stay was made in
the Petition in this matter, (and not in a formal Motion),
and the fact that the Agency has filed an Answer in this
matter. Neither ground presents substantive reasons which
would warrant a reversal of our prior Order. The Agency’s
Motion must be denied.
