SUPPLEMENTAL ORDER OF THE BOARD (by Mr. Goodman):
This matter comes before the Pollution Control Board (Board)
upon a letter received from Petitioner on February 13, 1976. The
Board will construe that letter as a motion to release its performance
bond and to be released from its obligation to file further quarterly
reports required by our October 30, 1975, Order in this matter.
Mt. Carmel Public Utility Company (Mt. Carmel) states that its 138
KV line was tied in to the Albion substation of CIPS and energized
on October 10, 1975. Its No. 4 coal-fired boiler was taken out of
service on that date. The line was tested and put into commercial
operation on October 13, 1975.
The Board finds that Mt. Carmel has made adequate progress in
the compliance program and that no reason exists for either the
continuation of the performance bond or the filing of quarterly re-
ports.
It is the Order of the Board that:
a) The Environmental Protection Agency
(Agency)
release Mt. Carmel’s $25,000.00 performance bond; and
b) Mt. Carmel be excused from filing further
quarterly progress reports with the Agency.
