ORDER OF THE BOARD (by Mr. Mar der)
Respondent filed its motion to dismiss petition for variance
on May 3, 1974. In its motion the reason for dismissal stated
was that there was no statement of hardship contained in the Pet-
ition, as required by our Procedural Rule 401 (b).
On May 8, 1974, Petitioneramended its Petition to include a
statement of hardship.
IT IS THE ORDER of the Pollution Control Board that Respond-
ent’s motion to dismiss is denied.
I, Christan L. Moffett, Clerk of the Illinois Pollution Control
Board, certify that the above Order was~adopted by the Board on the
16th day of May, 1974, by a vote of 5 to 0.
