ORDER OF THE BOARD (by Mr. Seaman):
On March 29, 1974, Scott Air Force Base filed its Petition For
Variance, seeking therein variance from the provisions of Rules 202,
203, 204, 206 and 207 of the Air Pollution Control Regulations. Petitioner
requests permission to operate two stand-by coal-fired heating plants
during the normal heating season, from approximately October 15 to
approximately April 15.
Petitioner presently relies on heating plants fueled by Number 6
fuel oil. While the current supply of the fuel Gil is adequate to
meet its short—term needs, Petitioner states that there is no assurance
that adequate supplies will be available for long-term requirements.
It
appears that Petitioner seeks permission to switch from the burning
of
fuel
oil to the uncontrolled burning of substantial quantities of
high-sulfur coal for an indefinite period of time (Petitioner’s prayer
for relief is for an ‘initial” period of one~year).
Under any circumstances, such a request could be considered only
on a showing of extreme hardship. The Petition before us does not
adequately address the hardship issue and is insufficient in other
respects. Petitioner’s attention is directed to the provisions of Rule
401 of the Board’s Procedural Rules, wherein the content of a petition
for variance is detailed.
Petitioner is hereby ordered to file an amended petition within
thirty (30) days of the date 0f this Order or suffer its cause to be
dismissed without prejudice as inadequate. Should Petitioner choose to
file an amended petition, it would be well to address the serious issues
and considerations raised in the Agency Recommendation. This will
necessitate filing a waiver with the Clerk of the Board on or before
June 20, 1974.
