OPINION AND ORDER OF THE BOARD (by Mr. Seaman)
This is a petition
for a variance filed by the
Kelsey-Hayes Company Gunite Division
(hereinafter
called
Petitioner)
of Rockford,
in Winnebago County.
The Environmental
Pr.otection Agency (hereinafter
called Agency) recommends a grant of the variance.
The Petitioner
produces heavy duty truck and trailer
wheels and drums.
At this plant, Petitioner
has two cupolas,
each is rated to process 28,400 lbs/hr.
Present pollution
control equipment consists of a wet scrubber, which,
according to stack tests conducted on June 17 and 18, 1969,
is sufficient
to meet both the old air pollution
control
regulations
and Rule 203(b) of Chapter 2, Part I of the
Pollution Control Board’s regulations.
Upon investigation
of means of controlling
carbon monoxide emissions,
Petitioner
determined that an afterburner
which would be successful
in
reducing CO emissions would increase particulate
emissions
beyond the limitations
set forth in Rule 203(b).
Therefore,
Petitioner
has embarked upon a program of modifying its
existing particulate
control system and installing
necessary
controls to meet CO standards.
Petitioner
is requesting
a
Variance from the compliance date of December 31, 1973
contained in Rule 206 of Chapter 2, Part II of the Regulations
of the Pollution
Control Board.
Petitioner
states that all
modifications
to its existing pollution
control system and
the installation
of CO control will be completed by December 1,
1974. Therefore, Peititoner is requesting a Variance for that
period of time.

Petitioner plans to make certain modifications to
its particulate emission system along with installation of
a scrubber.
Modifications will be complete
and
the
system will be operational by September 1, 1974. Petitioner
is requesting until December 1, 1974 to
insure
the system
is operating efficiently. Since Petitioner already
has
a scrubber on and is only modifying it, the time period
requested by Petitioner seems reasonable. Further, the
Agency is of the opinion that the control program will
reduce Co emissions to the levels established by Rule 206.
Petitioner, on his construction
permit
application,
estimated the cost of compliance to be $550,000. Initially,
it should be
noted that Petitioner was required to reduce
its gas supply by 25. Petitioner states it has been reallocated
and does not have to reduce its gas supply.
The
Agency
has received no complaints from the public
concerning this facility and there was no citizen testimony
at the public hearing on this cause.
This Opinion constitutes the findings of fact and
conclusions of
law
of the Board.
ORDER
IT IS THE ORDER of the bllution Control Board that
Kelsey-Hayes Company be
granted
a variance until December 31, 1974,
from Rule 203(b) of Chapter 2, Part I of the Pollution Control
Board Rules
and
Regulations and
Rule 206 of Chapter 2, Part
II of the Pollution Control Board Rules and Regulations,
subject to the following conditions:
(a) Petitioner shall submit in writing to:
