ORDER

rrhe Early & Daniel Company, Inc. has filed a petition
requesting variance to control emissions from grain elevator.
The petition does not specify which of our Regulations or
which Statutory provision
may
be involved. For that reason
the petitlon ~i1l be dismissed without prejudice. If
Petitioner chooses to file a new variance petition it should
state the Regulation or Statute from which a variance is
recuested.
Any new pleading should also take cognizance of the
following: Rule 401 of our Procedural Rules specifies require-
ments for a variance petition; on June 15, 1973 in R-72-l8 the
Board established May 30, 1975 as the new date for grain handling
and
conditioning operations to comply with Rule 203 and September 1,
1974
as
the
new date for the obtaining of an operating permit.
It is ordered that the variance petition be dismissed without
prejudice.
