ILLINOIS POLLUTION CONTROL BOARD
March 15, 1973
CHARLES E. SHANAFELT
#73-96
V.
ENVIRONMENTAL PROTECTION
AGENCY
ORDER OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
Letter has been received from petitioner which we interpret
as a request for variance from our sewer ban order entered in
League of Women Voters v. North Shore Sanitary District, ##70-7,
12, 13 and 14 (March 7, 1971) 1 PCB 369, to enable a sewer connec-
tion to facilities tributary to the Lake Bluff sewage treatment
plant. Petitioner alleges that his septic tanks are in bad
condition.
We are unable to tell from petitioner’s communication whether
a serious health hazard is likely if sewer connection is denied
and we do not know the costs and difficulties that might be en-
countered if the septic system was upgraded.
Petitioner shall file the requisite information within 15
days from receipt of this order, including a letter from the Lake
County Health Department indicating its evaluation of the future
suitability of the septic system.
The 90-day period in which a variance must be determined shall
begin to run from the date of the receipt of the foregoing submis-
sions. On failure to receive such submissions, the variance peti-
tion shall be dismissed.
IT IS SO ORDERED.
I, Christan Moffett, Clerk of the Illinois Pollutioi~Control Board,
certify that the above Order was adopted on the /~.r’~dayof March,
