ORDER OF THE BOARD (by Mr. Goodman):
On January 10, 1974, Space Builders filed an amended
petition for variance from a sewer extension ban imposed by
the Elgin Sanitary District in accordance with Section 912(b)
of Chapter 3, Water Pollution Regulations. The Environmental
Protection Agency’s upgrading of the Elgin District’s North
Plant loading capacity to 3.5 MGD (Permit #1974—DB-127-OP)
places the Distrit~tin compliance with Section 912 (b).
As there is no violation, the District may grant Peti-
tioner the requested sewer service. There is no necessity
for a variance. The petition for variance is therefore
dismissed as moot.
