OPINION AND ORDER OF THE BOARD (by Mr. Dumelle):
Petitioner filed a Variance Petition from Order #7
of League of Women Voters v. North Shore Sanitary District,
PCB7O-7, 12, 13, and 14 to allow him to connect a newly
constructed animal hospital sewer which is tributary to the
Clavey Road Sewage Treatment Plant. The Agency filed a
Recommendation to grant the variance on January 11, 1974.
Petitioner’s animal hospital is located at 1391 Northwestern
Avenue in Lake Forest, Lake County, Illinois in an area which
is currently under a sewer ban. Since Petitioner’s new facility
is not larger than his old animal hospital and the old one is
to be destroyed, a grant of Petitioner’s request would not result
in any additional load to the Clavey Road Sewage Treatment Plant.
To require Petitioner to wait until July 1, 1974 to connect
his hospital to the sewer system would work an arbitrary and
unreasonable hardship (See North Shore Sanitary District v.
EPA, PCB 73-134, Order).
This Opinion constitutes the Board’s findings of facts
and conclusions of law.
ORDER
The Illinois Pollution Control Board hereby grants Gerald F.
VerMeulen a variance from Order #7 of League of Women Voters v.
North Shore Sanitary District, PCB 70-7, 12, 13, and 14 to allow
a sewer connection for his animal hospital.

The Board hereby orders that the North Shore Sanitary
District subtract Petitioner’s population equivalent from the
total population equivalent granted to the District in
North Shore Sanitary District v, EPA, PCB 73-134.
IT IS SO ORDERED.
