INTERIM ORDER OF THE BOARD (by Mr. Dumelle)
The petition for variance filed in this proceeding with the
Board on June 18, 1973 is inadequate. The petition does not list
the regulation from which variance is requested and we do not know
whether there is a particulate problem, a sulfur oxides problem, a
carbon monoxide problem, or something else.
The type of coal to be burned is not specified and no data
are given as to effects upon air quality when it is used.
Petitioner is directed to file an amended petition within 21
days providing details as required by the Board’s Procedural Rule
401. A waiver of the 90-day decision period shall be submitted
by the petitioner for the period elapsed until the amended petition
is filed.
Failure to make a timely filing as detailed above shall subject
the petition to dismissal for inadequacy.
