OPINION AND ORDER OF THE BOARD (by Mr. Seaman):
Petitioner filed
its
request for variance with this Board
on April 26, 1973. Petitioner’s Champaign, Champaign County
facility processes soybeans, marketing feeds and soybean oil.
After drying, the soybeans are cracked, classified and flaked
before passing through a hexane oil extractor. Petitioner’s
request for variance concerns its white flake cooler. This
item is a rotary kiln cooler.
This cooler is handling desolventized, solvent extracted
soybean flakes at an average rate of 7,500 lbs/hr, using
5,800 fm of ambient air to cool the flakes to an acceptable
storage temperature. The existing control equipment is a high
efficiency cyclone (Carter—Day HV
51).
The emission from
this cyclone is 10 lbs/hr. The allowable emission is 9.9
lbs/hr. The emission is particulate matter composed completely
of soy dust.
Petitioner proposes to replace this cyclone with a high
energy centrifugal separator which will have an emission of
1 lb/hr, putting this source well within the limitations of
Pollution Control Board Regulations, Chapter 2: Part II,
Rule 203(a). Petitioner expects to have this new equipment
fully operational by December 15, 1973. The variance request
is to cover the time necessary to purchase and install the
new collection system.
Although the current violation is only slightly over the
allowance, the installation of this new equipment will
siqnificantly reduce emissions and also allow Petitioner to
recapture a valuable product. The Agency has received no
adverse comment from the public concerning this variance.

This Opinion constitutes the findings of fact and
conclusions of law of the Board.
IT IS THE ORDER of the Pollution Control Board that
Petitioner, Swift Edible Oil Company, be granted a variance
to operate its white flake cooler until December 15, 1973
subject to the following conditions:
1. Petitioner shall submit progress reports to the
Agency, in writing, on August 1, 1973, October 1, 1973, and
December 1, 1973, indicating progress toward completion of
the collection device on the white flake cooler; and
2. Petitioner shall notify the Agency, in writing, upon
completion of the project.
