OPINION AND ORDER OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
Petitioner seeks
a variance from our order
entered in League
of Women Voters v. North Shore Sanitary District, #70-7, to enable
construction of a recreation building that would discharge waste
into sewers tributary to the North Chicago facilities of the North
Shore Sanitary District.
The park district
is located in North Chicago
and the petitioner has represented that the persons using the facilities
would be principally from the North Chicago area.
The Agency has recommended that the petition be granted, subject
to several conditions which we believe are not necessary to impose.
We have granted variances of this nature for public recreational
facil-
ities in previous cases. See Tennis Development Corporation v. Environ-
mental

ber 31, 1971)

We believe the impact on the district facilities will
be minimal and disproportionate with the hardship imposed on the
community if the recreational facility is not constructed.
IT IS THE ORDER of the Pollution Control Board that petitioner,
Foss Park District, be granted a variance from the order of the Board
in League of Women Voters v. North Shore Sanitary District, #70-7, for
construction of a recreational building and connection to facilities
tributary to the North Shore Sanitary District sewage treatment plant.
