ORDER
OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
On
November 21, 1972, we denied the Agency’s motion to dismiss
the variance petition filed by LaClede Steel Company, and authorized
the Company to amend its petition to comply with our Procedural
Rules with respect to variances, within 10 days from the date of
the Order.
On December 5, 1972, we received a motion to re—consider our
November 21, 1972 Order on the grounds that the petitioner has
failed to comply with the provisions of said Order. On December 8,
1972, we received an amended petition for variance which we believe
conforms to our Procedural Rules, with respect to variances, and,
accordingly, deny the Agency’s motion to reconsider our November 21,
1972 order.
IT IS SO ORDERED.
