PRELIMINARY ORDER (by Mr. Parker)

By order dated October 3, 1972 we ordered Petitioner to

file an amended petition on or before October 31, 1972. On

October 27, 1972, we received from Petitioner a motion for

an extension of time to amend the variance Petition, the

extension being requested to permit adequate time for a

conference between representatives of Petitioner, the Agency,

and Kenroy, Inc. in order to clarify what information should

be included in the amended Petition. The motion for

extension of time seeks until November 30, 1972 in which to

file the amended Petition.

The motion for extension of time is hereby granted

to and including November 30, 1972 for Petitioner to file its

amended variance Petition on the condition that the amended

Petition include a statement by Petitioner that the 90 day

period provided for in Title 9, Section 38 of the Environmental

Protection Act shall commence as of the date of filing of the

amended Petition.
