INTERIM OPINION & ORDER OF THE BOARD (by Mr. Dumelle)
This is a petition for a one-year extension of the variance granted to
Edison on November 23, 1971 (PCB 70-21) from the thermal standards outside
of the applicable mixing zone on the Illinois River. That variance, by its
own terms, will expire on November 23, 1972.
We find it necessary to conduct a public hearing on this new petition
in order to fully comprehend the current
situation. Among
other
issues,
we would like to have more information on: the extent of the need for
Dresden power in view of the recent Quad-Cities plant startup; the degree
of improved water quality in this reach of the Illinois River as a result
of improved treatment upstream by both the GAF Corporation and the
Metropolitan Sanitary District of Greater Chicago; and the degree to which
the river diffuser acts as a barrier to the passage of fish.
The variance granted on November 23, 1971 is hereby extended for
sixty (60) days (January 22, 1973) on the condition that Edison files, by
November 1, 1972, a written waiver of the right to a final decision within
90 days from the filing date of the pending petition.
