ILLINOIS POLLUTION CONTROL BOARD
September

VILLAGE
OF
BRADFORD
#72—337
v.
ENVIRONMENTAL PROTECTION AGENCY
ORDER OF THE BOARD
(BY
SAMUEL T. LAWTON, JR.,)
Petition for variance was filed by the Village of Bradford
on
October 11, 1972, seeking relief from Rule 405 of the Water
Pollution Regulations relative to construction of temporary
chlorination facilities pending the completion of additions and
improvements to its sewage treatment plant. By our order of
August
15, 1972, we found the petition inadequate and directed
the
submission of additional facts, particularly with respect
to
the feasibility and cost of temporary chlorination facilities
and their effects upon the receiving stream.
On
September 14, we received a letter from the Village Presi-
3ent
stating that the Village was proceeding immediately with
~-emporarychlorination facilities and that plans would be sub-
nitted
for our approval. Since the facility the Village now
‘~roposesto construct is the one relative to which the variance
:~a5
sought, the petition for variance is dismissed as moot.
IT IS
SO ORDERED.
