In our Opinion and Order of October 17, 1972, extending the earlier
granted variance with respect to petitioner’s particulate emissions
from its coal fired boilers to May 30, 1973, we provide as follows:

The Board retains jurisdiction for such other and
further Orders as
may be appropriate with respect to
sulphur dioxide emissions based upon the Agency’s
response to report on results of continuous monitoring
previously submitted by the petitioner
and
the Agency’p
capability of determining sulphur dioxide emissions on
the basis of data furnished by petitioner to the Agency.
Modification of this Order shall be considered on
petition
of either party hereto.”
The Agency’ s response has been received and is highly critical of
the methods employed in the testing procedure
and
the conclusions
reached. Clearly, substantial factual questions are raised by the
monitoring report and the Agency ‘s response. A hearing will be
held on the issue
of
contiiiuing sulphur dioxide emissions and
possible
crop
damage
in
the vicinity of petitioner’s plant. The
Board will enter such other and further orders as shall be
appropriate upon receipt of the hearing record and transcript.
