ORDER OF THE BOARD (BY SAMUEL T. LAWTON, JR.):
A petition to remit the balance of the penalty has been filed
by Respondent. Our original Order of November 14, 1972 imposed a
penalty in the amount of $2,000 against Respondent for various open
dumping violations as found to have been committed, as set forth in
the Opinion.
On January 16, 1973, on Respondent’s Motion for Reconsideration,
we entered an Order permitting installment payment of the penalty
providing that the entire sum be remitted within one year from the
date of the Order.
The present motion to remit the balance of the penalty recites
that payment in the amount of $800 has been made and that $1,200
remains to be paid.Respondent alleges that the penalty as originally
assessed was punitive
and
not warranted under the circumstances.
No reasons
are set forth indicating in any way wherein
the
Board~s
original determination was erroneous, nor are reasons asserted that
would pursuade the Board to discharge the unpaid portion
of
the
penalty.
The petition to remit is accordingly denied.
