Preliminary Order of the Board (by Mr. Currie):
Illinois Power asks to be exempted from our new sulfur
dioxide emission regulations with regard to its large Wood River
unit #1. The company fnvites us to take official notice
of our voluminous record as to technology for sulfur dioxide
control just compiled in #R 71-23, Emission Standards, as a
result of which the regulations were adopted. We shall do so,
as we have no intention of repeating all that evidence in the
present proceeding. We hereby authorize a hearing limited
to facts relevant to the unit in question that allegedly make
compliance there a particular hardship as contrasted with a
relitigation of the merits of the regulation as a whole. That
issue has been fully litigated and decided in the extensive
rule-making proceeding in which Illinois Power participated
most considerably.
I, Christan Moffett, Clerk of the Pollution Control Board,
certify that the Board adopted the above Preliminary Order
this 10th day of May by a vote of 5-0.
