ILLINOIS POLLUTION CONTROL BOARD
April 25, 1972
VILLAGE OF COULTERVILLE
v.
)
PCB 72—167
ENVIRONMENTAL PROTECTION AGENCY
OPINION OF THE BOARD (by Mr. Kissel):
The Village of Coulterville (“Coulterville”) requested a
variance from the Board on April 21, 1972. Coulterville seeks an
extension in the deadline for making “sewage treatment improvements”
to meet current water quality standards from July 1, 1972 to
December 30, 1973. On the face of the petition, it is unclear as
to what deadline and fro~nwhat standards Coulterville seeks to be
excused. If the extension is for the advanced waste treatment
deadlines and standards for intrastate waters under
SWB-14,
the
Board’s recently adopted Water Quality Standards, R7l-l4, Chapter
III, Section 404, extends such deadline for compliance until
December 31, 1973. The deadline for installation of chlorination
facilities, however, was not similarly extended.
Since we find it impossible to determine the relief which
the petitioner seeks, the petition must be dismissed. ‘Should
Coulterville need to resubmit a variance petition, we would call
attention to Rule 401 of the Procedural Rules of the Pollution Con-
trol Board which sets forth the information to be contained in a
variance petition, and to Rule 401(a) (3) in particular which
asks for “a clear statement of the precise extent of the relief
sought”.
The petition is dismissed without prejudice.
I, Christan L. Moffett, Clerk of the Pollution Control Board,
certify that the above Opinion and Order was adopted this ~
day of April, 1972, by a vote of
