    Opinion and Order of the Board (by Mr. Currie)
    Andros asks a variance from our order forbidding the addition
    of new or increased wastes to overloaded treatment facilities in
    the North Shore Sanitary District (League of Women Voters v.
    NSSD, # 70—7, March 31, 1971). The petition does not allege
    facts sufficient to justify the request, and it must he dismissed.
    The plan is to replace an existing rooming house of 13 units
    with a new apartment building~of 19. It is clear that an increase
    in wastes discharged will result, and no special hardship is alleged.
    Even if all the facts alleged were proved, we could not there-
    fore grant the variance. See Wojcik v. EPA, # 7l-35Q, January
    6, 1972, and cases cited. The petition is hereby dismissed.
    We call attention to the pending proceeding by the District
    itself, # 71-343, in which a partial relaxation of the ban is
    sought which might benefit petitioners such as that in the
    present case.
