Opinion and Order of
the
Board
(by Mr. Currie):
This amended petition sought reconsideration of the Board’s
order dismissing earlier petitions for stated deficiencies, ## 71-
218, 71-219, October
26,
1971; ~7l-344 (Preliminary Order), December
6. 1971. On June 13, 1972 Counsel
for
Petitioners requested that
the Board dismiss the above-referenced petitions for variance.
Counsel stated that the proofs adduced in the various cases re-
lated to the adequacy of the facilities
of
the North Shore Sanitary
District, which matters have now been resolved. Counsel further
stated that petitioner’s applications for sewer connection permits
filed with the North Shore Sanitary District had been denied on the
basis that the
City
of Waukegan sewers were insufficient to transport
the
wastes
in
question
to
the District’s facilities. Since the
evidence submitted at the Board’s earlier hearings into this matter
do not, as Counsel points out, provide information relative to the
City of Waukegan sewer system, petitioners ask that their case be
dismissed. Accordingly, this matter is hereby dismissed without
prejudice.
