ILLINOIS POLLUTION CONTROL BOARD
September 30, 1971
GERALD L. AND SHIRLEY J. CRANK

ENVIRONMENTAL PROTECTION AGENCY
Opinion and Order of the Board (by Mr. Currie):
This variance petition sought permission to burn four farm
buildings despite the open-burning regulations. We scheduled a
hearing to determine whether, as required for a variance, compliance
with the law would impose an arbitrary or unreasonable hardship:
Just before the hearing date, however, the petitioners reported that
they had sold the disputed buildings and the lumber had been removed
from the premises without burning. Thus a potential air pollution
problem has been turned into a reusable resource, and there is no
controversy before us for decision, The motion to withdraw the
petition for variance is granted.
I. Regina E. Ryan, Clerk of the Pollution Control Board, certify
that the Board adopted the above Opinion and Order this
