Opinion and
Order of the Board (by Mr. Currie):
These
are
two more petitions for variances to allow onen
burning of small quantities of fuel ~teinstruct employees in
firefighting techniques, We have consistently held, that such
burning, under appropriate conditions, is justifi~h1e (e,a,,
Deere
&
Co. v. EPA, * 70-~20, Dec. 22, 1970), We grant these two
petitions
on
conditions suggested by the Agency,
Amoco Chemicals Corps is hereby granted permission to conduct
open burning for firefighting instruction purposes until November
1,
1971, and Union Oil Co. until July 22, 1972, subject to the
following conditions:
I) Burning shall take place at the locations described in
the petitions; types and amounts of materials burned and frecuency
and duration of burning shall be as described in the petitions;
2) burning shall take place only when the wind speed is from
5~20mph and only when the sky is not overcast;
3)
burning shall be confined
to the
period from 11:00
a,a,
to 4:00 p.m.;
4) petitioners shall file a report every
six
months with
the Agency briefly describing each traininq session, Pach deQcrintion
shall state the number of trainees attending, the types and amounts
of combustibles burned, the date and time of

duration of burning, the estimated smoke e issions and a descr~pt~n
the weather conditions.
