HEARING OFFICER ORDER
On December 8, 2008, all parties participated in a telephonic status conference
with the hearing officer. The respondent’s attorney, Assistant Attorney General Gerald
Karr, was directed to file his appearance. Mr. Karr represented that it intends to file the
record on or before December 11, 2008.
The parties were directed to submit their respective witness list on or before
December 19, 2008. The petitioner indicated that it may submit pre-filed testimony. If
so, the pre-filed testimony is due to be filed on or before December 22, 2008. Any pre-
hearing motions, including motions
in limine
, are due to be filed on or before December
31, 2008. Responses are due to be filed on or before January 5, 2009. The mailbox rule
will not apply to the above-mentioned filings, and all electronic or approved telefax
filings must be received by the Clerks office no later than 4:30 p.m. of the due date.
The petitioner represented that it will file an additional waiver of the statutory
decision deadline to and including April 3, 2009.
The parties or their legal representatives are directed to participate in a telephonic
pre-hearing conference with the hearing officer on January 6, 2009, at 9:30 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
