HEARING OFFICER ORDER
On November 24, 2008, all parties participated in a telephonic status conference
with the hearing officer. Hearing dates were discussed in the event that a hearing is
required to be held, pursuant to Section 104.234 of the Board’s procedural rules.
Tentative hearing dates of January 5 or 6, 2009, were discussed.
Further, the respondent represented that it anticipates that it will file a motion for
leave to file a reply, and the reply to petitioner’s response to the Illinois Environmental
Protection Agency’s (Agency) recommendation on or before December 3, 2008, not
November 26, 2008, as previously discussed. Petitioner’s response is due to be filed on
or before November 25, 2008.
Further discussions regarding scheduling a hearing, if needed, will take place at
the next telephonic status conference.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on December 8, 2008, at 10:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
