HEARING OFFICER ORDER
On November 20, 2008, all parties participated in a telephonic status conference
with the hearing officer. Discussions centered on briefing schedules in response to the
Illinois Environmental Protection Agency’s (Agency) recommendation, filed November
17, 2008. It was agreed that petitioner’s response is due to be filed on or before
November 25, 2008. The Agency’s reply, if any, is due to be filed on or before
November 26, 2008. The mailbox rule will not apply, and all electronic or approved
telefax filings must be received by the Clerk’s office no later than 4:30 p.m. of the due
date.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on November 24, 2008, at 10:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties
must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
