ORDER OF THE BOARD (by G.T. Girard):

On October 26, 2007, the Illinois Environmental Protection Agency filed a proposal under the general rulemaking provisions of Sections 27 and 28 of the Environmental Protection Act (415 ILCS 5/27, 28 (2006)). A motion to hold the hearings in Chicago and Joliet accompanied the proposal. The Board accepted the proposal for hearing on November 1, 2007, but reserved ruling on the motion to hold hearings in Chicago and Joliet until the response time had run. See 35 Ill. Adm. Code 101.500(d). The Board has received no responses to the motion. Therefore, any objection to granting the motion is deemed waived. Id. The Board grants the motion and will attempt to hold the hearings in Chicago and Joliet.

     IT IS SO ORDERED.

I, John T. Therriault, Assistant Clerk of the Illinois Pollution Control Board, certify that the Board adopted the above order on November 15, 2007, by a vote of 4-0.
