HEARING OFFICER ORDER
On September 22, 2008, the parties participated in a telephone status conference
with the hearing officer. Tom Davis from the Office of the Attorney General will be
filing an appearance on behalf of respondent. Petitioner submitted comments on the
proposed permit requirements to respondent, and is awaiting a response. Respondent’s
attorney will contact the technical unit to find out when a response may be prepared so
that the parties can schedule a meeting. The parties are discussing the possibility of
settlement, and agree that the record shall not be due until such time as it appears that a
hearing will be needed.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:30 a.m. on November 6, 2008. The status conference shall be
initiated by the complainant.
Petitioner filed an open waiver of the decision deadline.
