HEARING OFFICER ORDER
On July 3, 2008, all parties participated in a telephonic status conference with the
hearing officer. Discussions included scheduling a hearing date. It was agreed that a
hearing in the above-referenced will be scheduled for August 14 and 15, 2008. The time
and location of the hearing will be noted in the notice of hearing.
The respondents have filed their respective motions to dismiss, and it is
anticipated that the petitioner will file its response by July 18, 2008. It is uncertain when
the Board will rule on the motions. To that end, it is assumed the parties have initiated
discovery. Further discussions regarding discovery will be entertained at the next
telephonic status conference.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on July 22, 2008, at 11:00 a.m. Please notify
the hearing officer if there is a scheduling conflict. The telephonic status conference
must be initiated by the petitioner, but each party is nonetheless responsible for its own
appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter.
