HEARING OFFICER ORDER
On November 17, 2008, the parties participated in a telephone status conference
with the hearing officer. The parties are making progress in settlement discussions, and
petitioner will send recent sampling results to respondent. Petitioner agreed to file a
deadline waiver to
May 21, 2009 within the next seven days.
The parties are directed to participate in a telephone status conference with the
hearing officer at 2:00 p.m. on January 12, 2009. The status conference shall be initiated
by the petitioner.
The decision deadline is February 24, 2009.
